General Terms and Conditions

We maken gezondheid inzichtelijker, makkelijker en persoonlijker. Om duidelijkheid te geven, lees je hieronder de spelregels die gelden als je onze diensten gebruikt.
Article 1 – Definitions
Cooling-off period/right of withdrawal: the statutory cooling-off period of 14 days during which a consumer may cancel free of charge, as long as the service has not yet been performed.
Consumer: a natural person who is not acting in a professional or business capacity.
Professional: an organization or self-employed person who purchases or uses the Multiscan for commercial or professional purposes.
Day: calendar day.
Long-term transaction: an agreement whereby you receive services for a longer period of time (e.g., lease or subscription).
Durable medium: a way to store information (e.g., PDF or email).
Entrepreneur: Charged BV.
Distance agreement: an agreement that you enter into with us via the website or email.

Article 3 – When these terms and conditions apply
These terms and conditions apply to every offer, agreement, and use of the Multiscan, the accompanying software, and reports. You can read, save, or request them in advance. If there are specific agreements in addition to these terms and conditions, the provision that is most favorable to you will always apply.
By using Multiscan as a consumer, you agree to these terms and conditions and to the Privacy and Disclaimer document, available at www.charged.health/privacy-disclaimers.
For business users, the provisions of Article 15 (B2B terms and conditions) also apply.
Article 4 – Our offer
Our offer is non-binding and subject to change.
We describe as clearly as possible what you will receive (e.g., health scan).
Each offer states: the price, any additional costs, whether the right of withdrawal applies, and how you can cancel or pay.
Errors or mistakes in price or description are not binding on Charged.
Article 5 – The agreement
The agreement comes into effect as soon as you accept our offer and pay or book an appointment.
You will receive immediate confirmation by email or in the app.
We provide a secure environment for online payments.
We may check in advance whether you are able to meet your payment obligations.
Article 6 – What we do and do not do
The Multiscan is not a medical examination and does not replace medical diagnosis, treatment, or advice. We do not make diagnoses, treat illnesses, or prescribe medication.
Our scans and reports provide insight into lifestyle and vitality and are not medical examinations or treatments.
For medical questions or complaints, we always refer to a doctor or specialist.
Article 7 – Partners and (medical) procedures
We work together with authorized partners.
These partners are fully responsible for the performance and outcome of their services.
Charged is not liable for damage resulting from actions or negligence on the part of these partners.
If you work with one of our partners, please ask them for the applicable terms and conditions.
Article 8 – Right of withdrawal for services (consumers)
You may cancel a service (e.g., health scan) that you book with us free of charge within 14 days of booking and up to 24 hours before the appointment, as long as it has not yet been performed.
Do you agree that the service will be performed immediately (e.g., appointment within 14 days) and has the service been provided? Then the right of withdrawal expires.
Our partners may have their own terms and conditions. Please request these where applicable.
Article 9 – Cancellation fees
If you cancel an appointment less than 24 hours before the start time, or if you do not show up, we may charge you for the cost of the missed session.
Within the 14-day cancellation period and before execution, you will receive a full refund.
Article 10 – Prices and payment
For private individuals, prices always include VAT.
For business customers and partnerships, prices are always exclusive of VAT, unless otherwise stated.
Payment must always be made in advance, unless otherwise agreed in writing. Incorrect payment details must be reported immediately.
In the event of non-payment, reasonable collection costs may be charged.
Obvious errors in price listings are not binding.
Article 11 – Duration, lease, and subscriptions
Consumers
You can always cancel open-ended subscriptions with a maximum notice period of one month.
Fixed-term subscriptions can be canceled at the end of the term, also with a maximum notice period of one month.
Subscriptions are not automatically renewed unless this has been clearly agreed in advance.
Professionals For leasing, we work with external partners. The terms and conditions of the relevant partner apply.
Article 12 – Liability
Charged Health is not liable for any medical consequences that you associate with our insights or advice. For medical care, we always refer to doctors.
Use of the Multiscan and interpretation of results is at your own responsibility.
We are not responsible for damage caused by misuse of our services or by services provided by partners.
Our liability is always limited to the amount you paid for the service in question.
Article 13 – Complaints
Do you have a complaint? Report it as soon as possible, within two months at the latest, to info@charged.health.
You will receive a response within 14 days.
If we cannot resolve the issue together, you can submit your complaint to an independent dispute resolution body.
Article 14 – Data protection
We process personal data in accordance with applicable privacy legislation (GDPR).
The way in which we collect, secure, and use data is described in our Privacy and Disclaimer document.
By using Multiscan, you agree to this policy.
Partners are responsible for the collection, security, and use of personal data. Please request the applicable terms and conditions from the relevant partner.
Article 15 – Additional provisions for professionals (B2B)
For professionals, the Multiscan and accompanying reports may only be used within the agreed business context (e.g., prevention programs, vitality services, or team measurements).
The right of withdrawal does not apply to business agreements.
All intellectual property rights to the Multiscan software, reports, and analyses remain with Charged.
The professional indemnifies Charged against claims from third parties arising from the use of the Multiscan in their own business operations.
All B2B agreements are governed exclusively by Dutch law. The competent court in Amsterdam has exclusive jurisdiction.
Article 16 – Final provisions
These terms and conditions are governed by Dutch law.
Additional agreements or deviations are only valid if recorded in writing.
The Vienna Sales Convention is expressly excluded.
If any provision is declared invalid, the remaining provisions shall remain in full force and effect.
In summary: Multiscan helps you with your health, lifestyle, and vitality through scans and reports. We are not a healthcare provider and do not replace medical advice. For medical questions, always consult your doctor or specialist.
